Heard the counsel for the petitioner.

The present petition has been filed challenging the order dated 24.2.2022 passed by the Principal Judge, Family Court, Deoria in Misc. Case No. 42 of 2021.

Misc. Case No. 42 of 2021 was registered at the instance of the opposite party, the wife, for recall of the judgment and decree dated 25.2.2021 passed in Case No. 534 of 2019 registered under Section 12 of the Hindu Marriage Act, 1955 whereby the said case was decreed ex-parte against the opposite party.

There is no jurisdictional error or any other illegality in the aforesaid order. The order has been passed after considering the relevant factors and the prayer to quash the said order stands rejected.

However, considering the circumstances of the case, the Principal Judge, Family Court, Deoria is directed to decide Case No. 534 of 2019 expeditiously, preferably within a period of one year from the date a certified copy of this order is produced before him, in case, there is no legal impediment in deciding the aforesaid case.

It is clarified that this Court has not expressed any opinion on the merits of the claim of the petitioner.

With the aforesaid direction, the petition is disposed of.
