Heard learned counsel for the applicants and the learned A.G.A.

By means of this present application the applicants are seeking quashing of charge-sheet dated 1.12.2021 and cognizance/summoning order dated 25.1.2022 passed by Civil Judge (S.D.)/F.T.C. 1st A.C.J.M., Deoria as well as entire proceedings of Criminal Case No.973 of 2022, (State Vs. Musafir and others) arising out of Case Crime No.105 of 2021 under Sections 147, 148, 149, 323, 504, 506, 325, 427 and 308 of I.P.C., Police Station-Bhatani, District-Deoria, pending in the court of Civil Judge (Senior Division)/ Additional Chief Judicial Magistrate/F.T.C. 1st, Deoria.

Learned counsel for the applicants submits that the applicants are ready to appear before the Court concerned, file bail application and in case the bail application is filed, the same may be decided expeditiously.

In view of the above, prayers made in this application are rejected and this application is disposed of with the direction that in the event applicants surrender before the concerned court and thereafter files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
