Heard learned counsel for the applicants and the learned A.G.A.

By means of this present application the applicants are seeking quashing of the Criminal Case in S.S.T. No.542 of 2021 titled as (State Vs. Adheer and others) arising out of Case Crime No.0023 of 2021 under Sections 323, 504, 325, 352 of I.P.C. and 3 (1) Da, 3 (1) Dha of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station-Kotwali Chunar, District-Mirzapur, pending in the court of Special Judge (S.C./S.T. Act) Mirzapur and quash the cognizance/summoning order dated 9.12.2021 in Case Crime No.0023 of 2021,under Sections 323, 504, 325, 352 of I.P.C. and 3 (1) Da, 3 (1) Dha of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station-Kotwali Chunar, District-Mirzapur.

Learned counsel for the applicants submits that the applicants are ready to appear before the Court concerned, file bail application and in case the bail application is filed, the same may be decided expeditiously.

In view of the above, prayers made in this application are rejected and this application is disposed of with the direction that in the event applicants surrender before the concerned court and thereafter files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
