Heard learned counsel for the applicant and the learned A.G.A.
By means of this present application the applicant is seeking quashing of the summoning order dated 6.1.2020 passed by Prescribed Authority/Additional Chief Judicial Magistrate, Court No.3, Agra, in Complaint Case No.3249 of 2019 (Madhvendra Singh vs. Chand Miyan) under section 138 of N.I. Act,, Police Station-Chhhata, District Agra, pending in the court of Additional Chief Judicial Magistrate, Court No.3, Agra.
Learned counsel for the applicant submits that the applicant is ready to appear before the Court concerned within a period of two weeks file bail application and in case the bail application is filed, the same may be decided expeditiously.
In view of the above, prayers made in this application are rejected. and this application is disposed of with the direction that in the event applicant surrenders within a period of two weeks and thereafter files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
