Heard Sri Mohd. Nuruddin Khan, Advocate holding brief of Sri S.A.N. Shah, learned counsel for the appellant and Ms. Arti Agarwal, learned State.

The present appeal has been filed by the appellant Haseen Adil against the judgment and order dated 24.04.1996 passed by Special Judge (E.C. Act)/Additional District and Sessions Judge, Kanpur Nagar in Sessions Trial No. 640 of 1994, Police Station Phalkhana, District Kanpur Nagar.

As per office report dated 14.10.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 09.04.2021 informed that the appellant - Haseen Adil has died many years ago. In support of which a report of concerned police station and the copy of death certificate issued by Councillor, Chunniganj, Kanpur Nagar and the copy of the statement of the other witness have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
