Sri Ankit Srivastava, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Ran Vijay against the judgment and order dated 16.04.1993 passed by II Additional Sessions Judge, Banda in Sessions Trial No. 120 of 1991, Police Station Bisanda, District Banda.

As per office report dated 20.11.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 26.10.2022 informed that the appellant - Ran Vijay has died 28 years ago. In support of which a report of concerned police station and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
