Ms. Arti Agarwal, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Sevati against the judgment and order dated 16.11.1989 passed by Special Judge (D.A.A.), Etah in Sessions Trial No. 272 of 1984, Police Station GRP Kasganj, District Etah.

As per office report dated 26.11.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 18.10.2022 informed that the appellant - Sevati has died on 08.06.1999. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
