Sri Shashi Kant Pandey, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Talewar against the judgment and order dated 21.12.1985 passed by VI Additional District Judge, Aligarh in Sessions Trial No. 149 of 1985, Police Station Civil Line, District Aligarh.

As per office report dated 07.12.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 03.09.2022 informed that the appellant - Talewar has died. In support of which a report of concerned police station and the copy of death certificate issued by New Delhi Municipal Council and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
