Heard the counsel for the petitioners and the learned Standing Counsel.

The counsel for the petitioners argues that the petitioners were regularized, however after the retirement, their claim for grant of pension is not considered taking into account the services rendered by them prior to the regularization. He places reliance on the judgment of Hon'ble the Apex Court in the case of Prem Singh vs. State of U.P. and others reported in 2019 (3) ESC 801.

Considering the fact that the decision is to be taken by the respondent no.2, the present petition is disposed offgiving liberty to the petitioner to move a fresh application before the respondent no.2 along with whatever judgments he may be advised, which shall be decided in accordance with law with all expedition preferably within a period of three months from the date of the representation.
