Sri Rishabh Agarwal, learned counsel for applicant fairly submits that till date opposite party No.2 and 3 have not appeared, therefore, this application be disposed of with liberty to applicant to move an appropriate application before Additional Chief Judicial Magistrate-VI, Agra in Complaint Case No. 374 of 2019 (Chowdhary Basheer vs. Al-Sifa Food Frozen and another) under Section 138 of N.I. Act, Police Station- Mantola, District- Agra in the light of judgment of Supreme Court in Re-: Expeditious trial of cases under Section 138 N.I. Act, 1881 (Suo Moto Writ Petition (Crl.) No. 2 of 2020) reported in 2021 SCC Online SC 325.

In view of the above, prayers made in this application are rejected.

Application is disposed of with the direction to Court concerned that directions passed by Supreme Court in Re-:Expeditious trial of cases under Section 138 N.I. Act, 1881, (Suo Moto Writ Petition (Crl.) No.2 of 2020) reported in 2021 SCC Online SC 325 be complied with expeditiously.
