Sri Ankit Srivastava,learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Chutakunu @ Chhotey Lal against the judgment and order dated 26.09.1986 passed by Special Judge/Additional Sessions Judge, Shahjahanpur in Sessions Trial No. 141 of 1986, Police Station Ussait, District Budaun.

As per office report dated 13.05.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 02.03.2022 informed that the appellant-Chutakunu @ Chhotey Lal has died. In support of which a report of concerned police station and the certified copy of the village pradhan have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
