This application has been filed for directing the Court of learned Additional Chief Judicial Magistrate, Court No.4, Jaunpur to decide the Case No.377 of 2014 (Saroj Singh Vs. MahantheySingh) under Section 138 N.I. Act, P.S.-Rampur, disrict-Jaunpur within stipulated time which is pending since 26.7.2014.
Applicant is a complainant in Case No.377 of 2014 filed under Section 138 N.I.Act. However, till date, it has not been decided.
From the order sheet, it appears that the case was adjourned on the ground that the court was vacant.
Recently, a direction has been sent to all the district court's that no matter be kept pending only on the ground that the court is vacant.
Speedy trial is a right of complainant as well as of the accused provided under Article 21 of the Constitution of India and it has been upheld in various judgment passed by this Court as well as by the Supreme Court.
In view of the above, this application is disposed of with a direction that the trial court shall conclude the trial within a period of period of six months from today in accordance with law, if there is no other legal impediment.
