Heard Sri S.K. Kakkar, learned counsel for appellant, Sri Harish Chandra Mishra, learned counsel appearing for claimant-respondent no.1 and perused the record.

This first appeal from order has been filed against the judgment and order dated 26.7.1994 passed by Special Judge (E.C. Act)/Motor Accident Claims Tribunal, Jhansi in M.A.C.P. No.5 of 1989 (Ram Rakshpal Singh Vs. Ganga Prasad and others), by which the interim compensation of Rs.25,000/- has been awarded to the claimant-respondent no.1.

Record shows that 28 years have been passed but counsel appearing for the parties are not in a position to state about the status of the claim petition.

The present appeal has been filed by the appellant Insurance Company against the order of interim compensation awarded under Section 140 of Motor Vehicles Act, 1988, which is always liable to be adjusted in final award.

The appeal is dismissed.

Interim order, if any, stands vacated.
