Heard learned counsel for petitioner and learned State counsel appearing on behalf of respondents no.1 to 3.

In view of order being proposed to be passed, notices to respondent no.4 stand dispensed with.

Petition has been filed seeking a direction to the respondents to release gratuity alongwith interest or in the alternative to decide his representation.

Learned counsel for petitioner submits that the Institution in question namely Gramodaya Inter College, Gaura Badshahpur Jaunpur is a recognized and aided intermediate college in which the spouse of petitioner was engaged as Assistant Teacher and subsequently passed away in service prior to attaining the age of 56 years. It is submitted that the aforesaid matter is covered by Judgment rendered by this Court in the case of Guru Charan versus State of U.P. and others; Writ A No.8605 of 2022.

Learned State counsel does not dispute the applicability of aforesaid judgment in the present case and as such petition is allowed in terms of judgment and order dated 04.08.2022 passed in the aforesaid writ petition, petitioner shall be entitled to the same benefits as made available to the petitioner in the aforesaid writ petition within the same time frame.

The writ petition, as such, is allowed.
