The petitioner who is Seasonal Collection Amin, is aggrieved that his claim for regularization was rejected only on the ground that he is not fulfilled criteria of Seasonal Collection Amin. However, the said criteria was held to be contrary to law in terms of judgment passed by this Court in the case of Suresh Chandra Mishra Vs. State of U.P and others 2017 (1) AWC 120 (LB) which has also been held in the case of Pankaj Srivastava Vs. State of U.P. Thru Secy. Prin. Secy. Revenue Lucknow & Ors. (Service Single No. 8200 of 2019) vide order dated 18.1.2020. He further submits that the age for regularization is also relaxed up to 48 years and the petitioner is still within the said limit and he also submits that the claim of the petitioner may be considered afresh.

Learned Standing Counsel submits that the claim of the petitioner will be considered and this writ petition may be disposed of with appropriate directions.

In view of the above submissions, this writ petition is disposed of with direction to the concerned respondents to consider the case of the petitioner for regularization, keeping in mind the aforesaid judgments, in accordance with law, if there is no legal impediment.
