1. None appears for the revisionist to press this revision even in the revised call.
2. Learned A.G.A. is present for the State-respondent.
3. Present revision under section 397 Cr.P.C. read with section 401 Cr.P.C. has been filed against the Judgment and order dated 14-05-2009 passed by the learned Additional Sessions Judge/F.T.C., Court No. 5, Gonda in Sessions Trial No. 49/2009, arising out of Case Crime No. 249/1998, under sections 307/323 I.P.C., Police Station-Kotwali Dehat-district-Gonda.
4. The learned trial court after considering the evidence brought on record and submissions on behalf of the prosecution and defence did not find the guilt proved against the accused-respondents for offence under sections 307 and 323 I.P.C. and acquitted them for the charge for said offences. This court has considered the impugned Judgment and order and finds that the trial court has not committed any error in appreciating the evidence or error of law. The view taken by the learned trial court is plausible one.
5. This court, therefore, does not find any ground to interfere with the impugned Judgment and order dated 14-05-2009. The revision is dismissed.
