The present Jail Appeal has been preferred by the appellant through Jail.

Shri Ajeet Kumar Singh, learned counsel for the appellant in Criminal Appeal No.870 of 2021 and Ms. Ruhi Siddiqui, learned AGA for State-respondent are present.

It appears from the record and cause list that appellant- Ashwani, has preferred a regular Criminal Appeal No.870 of 2021 through his counsel Shri Ajeet Kumar Singh against the same judgment and order dated 09.04.2021 passed by the trial Court.

As connected Criminal Appeal No. 870 of 2021 and present Jail Appeal No.970 of 2021 preferred by the convict/ appellant- Ashwani arise out of the common judgment and order dated 09.04.2021, therefore, we deem it appropriate to consign Jail Appeal No. 970 of 2021 to records, with liberty to the appellant- Ashwani to pursue his Criminal Appeal No.870 of 2021, which he has preferred through his counsel Shri Ajeet Kumar Singh.

In view of the aforesaid, Jail Appeal No. 970 of 2021 is consigned to records.

Office is directed to delink Jail Appeal No. 970 of 2021 from Criminal Appeal No.870 of 2021.
