Heard Sri Sunil Kumar Yadav, learned counsel for the petitioner and Sri Shashi Prakash Singh, learned Senior Advocate and Additional Solicitor General of India assisted by Sri Sushil Kumar Pandey, learned counsel for the respondents.

The petitioner has approached this Court that his application for compassionate appointment as his father died in harness on 28.10.2019 was not considered.

Sri Shashi Prakash Singh, learned Additional Solicitor General of India assisted by Sri Sushil Kumar Pandey has tendered apology that none was present on behalf of Union of India on 22.07.2022 when this Court had issued bailable warrant for the appearance of respondent No.3. He fairly submits that in case the application of the petitioner for compassionate appointment is still pending, the same will be considered and decided expeditiously within a period of four months from today in accordance with law.

Sri Sunil Kumar Yadav, learned counsel for the petitioner has no objection in disposing of the writ petition.

In view of tendering apology and considering the fair submissions made by learned Additional Solicitor General of India which is even more fairly admitted by learned counsel for the petitioner, this writ petition is disposed of with a direction that in case any application on behalf of petitioner for compassionate appointment is still pending, the same will be considered and decided in accordance with law expeditiously, preferably within a period of six months from today as held in the judgment of Hon'ble Supreme Court in Malaya Nanda Sethy Vs. State of Orrisa and others reported in 2022 SCC Online SC 684.
