The present petition has been filed challenging the order dated 25.3.2022 passed by the District Judge, Aligarh in Misc.Case No.77/2022 registered under the Act No.13 of 1972.

The revision had been filed against the order dated 8.10.2015 passed by the Rent Control and Eviction Officer, District Aligarh and therefore, the revision was not maintainable in light of the judgment of this Court delivered in 2014(2) ARC 234.

It transpires from the record that the order dated 8.10.2015 was passed by the Rent Control Authority on an application of the petitioner registered under Sections 12/16 of Act No.13 of 1972 for allotment. The application has been rejected on the ground that vide order dated 5.1.1996, the accommodation had already been released in favour of opposite party no.1 in proceedings registered under Section 21(1)(a) of Act No.13 of 1972.

In view of the aforesaid, there is no illegality in the order dated 25.3.2022 passed by the District Judge, Aligarh in Misc.Case No.77 of 2022.

The petition lacks merit and is dismissed.
