None appears on behalf of the appellant to press this appeal.

However, Ms. Ruhi Siddiqui, learned Additional Government Advocate for the State-respondent is present.

The instant appeal arises out of judgment and order dated 31.08.2005 passed by the Additional Sessions Judge, Court No.7, Sitapur in Sessions Trial No. 575 of 1994, arising out of Case Crime No. 621 of 1994, under Sections 302/34 I.P.C., Police Station Kotwali, District Sitapur.

As per office report dated 22.10.2021, the Chief Judicial Magistrate, Sitapur has sent a report dated 07.10.2021 whereby it has been mentioned that the sole appellant-Bachan has died. In support of his report, he has enclosed the report of thana, death certificate and statements of witnesses.

In view of above, the appeal preferred by the sole appellant-Bachan stands abated.
