However, Sri Vishwas Shukla, learned Additional Government Advocate for the State-respondent is present.

The instant appeal arises out of judgment and order dated 22/24/02/2005 passed by the Additional Sessions Judge, Court No.31, Barabanki in Sessions Trial No. 251 of 2001, arising out of Case Crime No.298 of 2000, under Sections 148, 147, 302/149 I.P.C., Police Station Baddupur, District Barabanki.

Since it is an old appeal, a letter has been sent to the Chief Judicial Magistrate concerned to know about the living status of the appellant.

Pursuant to the above, the office has reported vide its report dated 22.10.2021 that the Chief Judicial Magistrate, Barabanki has sent a report alongwith relevant enclosures dated 08.10.2021 mentioning that the sole appellant-Radhey Lal had died.

In view of above, the appeal stands abated in respect of the sole appellant-Radhey Lal.
