Heard learned counsel for the parties, learned A.G.A. for the State and perused the material on record of this appeal.

This appeal has been preferred by appellant- Sheo Managal against the judgment and order of Special Judge (SC/ST) Act, Unnao dated 30.9.2003 in S.T. No. 97 of 2001 and S.T. No.137 of 2001 arising out of Crime No.237 of 2000, Police Station- Purwa, District Unnao, convicting and sentencing the appellant under Sections 147, 148, 302/149 and 506 IPC.

From perusal of the report of the Chief Judicial Magistrate, Unnao dated 23.09.2021 which is on record of this appeal, it transpires that the sole appellant in this appeal- Sheo Managal has died.

Learned A.G.A. has submitted that in view of the report of Chief Judicial Magistrate, Unnao dated 23.09.2021, this appeal is liable to be abated.

In view of the submission made by learned A.G.A and on perusal of the recitals contained in report of Chief Judicial Magistrate, Unnao this appeal is dismissed as abated.
