This intra-court appeal has been filed, assailing the order of the learned Single Judge dated 30.11.2021 passed in Writ-C No.17225 of 2021 (Nanhe Lal vs. State of Uttar Pradesh & Another) whereby the writ petition was dismissed.
Sri K Shahi, learned counsel appearing for respondent no.2, submits that the issue involved in the present appeal is no longer res integra and stands concluded by the decision of a coordinate Bench of this Court passed in Special Appeal Defective No.446 of 2020; Special Appeal Defective No.55 of 2021; Special Appeal No.481 of 2021 and Special Appeal Defective Nos.695 & 818 of 2021, decided by a common judgment dated 8.3.2022, whereunder the special appeals have been dismissed.
Learned counsel appearing for the appellant does not dispute the aforesaid position.
Accordingly, we do not find any merit in the present special appeal and the same stands dismissed in the light of the judgment passed in the above-mentioned special appeals.
