1. Supplementary counter affidavit filed today in Court, may be taken on record.

2. Heard learned counsel for the applicant and Shri Kuldeep Pati Tripathi, learned Additional Advocate General assisted by Shri Manjeet Shukla, learned Additional Chief Standing Counsel for the respondents-State.

3. By means for the present contempt application, the applicant has alleged non-compliance of the judgment and orders dated 10.5.2012 and 28.3.2017 by means of which Writ Petition No.6698 (SS) of 2009 was allowed setting aside the orders dated 7.9.2009 and 6.1.1999 with the direction that consequential shall follow and the second order was that the judgment and order of the appeal is therefore modified and the appeal is disposed of by directing the respondents to take a decision afresh for compliance of judgment and order dated 10.5.2012 in Writ Pettiion No.6698 (SS) of 2009 in its entirety since Special Appeal Defeictive No.835 of 2012 which was the reason shown by respondents for not taking any further decision, has already been dismissed. The aforesaid decision shall be taken by respondents within a period of three months from the date of production of a certified copy of this order.

In compliance of the above referred judgments and orders, on 2.12.2017 a decision has been taken whereby seniority has been granted to the petitioner and in regard to grant of promotion, separate order was directed to be passed in case he was found eligible. In regard to the backwages, opinion was sought and after getting opinion, decision shall be taken.

6. In view of the above, in the opinion of this Court, the orders of the writ Court as well as special appeal Bench have been complied with and there is no deliberate and willful disobedience of the orders passed by this Court.

7. Accordingly, this contempt application is dismissed and consigned to record.
