Order on Delay Condonation Application
Submission made by the counsel that initially 482 Cr.P.C. application was filed which was dismissed as withdrawn with liberty to file the present criminal revision and this is the reason behind the delay in filing the present criminal revision.
Cause shown is sufficient. The delay in filing the present criminal appeal is condoned.
The delay condonation application is allowed.
Office is directed to allot regular number to the present criminal appeal.
Order on Revision
By means of the present criminal revision, the revisionist is assailing the legality and validity of the judgment and order dated 17.05.2019 whereby 156(3) Cr.P.C. was converted into complaint case and after recording of statement under Section 200 and 202 Cr.P.C., the A.C.J.M., Court No.8, Agra has summoned the accused persons, namely, Tara Devi, Udairam, Smt. Bhoori and Harikishan under Sections 452, 323, 504 and 506 IPC.
I have perused the order impugned and I do not find any illegality or perversity in the order of summoning 17.05.2019, accordingly, the present criminal revision is devoid of merit and is dismissed.
However, the revisionist is directed to surrender before the court below within 15 days and apply for bail and get himself bailed out.
After being bailed out, if so advised the revisionist may file discharge application.
