Heard learned counsel for the petitioners.
The Union of India in the present writ petition has come up against the judgement and order passed by the Central Administrative Tribunal in O.A. No. 330/00469/2018 on 24.1.2022 whereby the O.A. filed by the opposite party no. 2 claiming promotion on the higher post has been allowed and the impugned order assailed therein was quashed. The recommendations of the departmental promotion committee were directed to be implemented from the due date.
We have carefully gone through the judgment impugned herein this writ petition. It is gathered from paragraph 6 of the impugned judgment that opposite party no. 2 was found fully eligible and qualified for being promoted on the higher post. The mere pendency of the criminal case unrelated to the official duties was the sole premise on the basis of which the grant of promotion was denied.
The learned tribunal has recorded satisfactory reasons for allowing the O.A. The reasons recorded by the learned tribunal, in our humble opinion, do not call for any interference in exercise of extraordinary jurisdiction of this Court under Article 226 of the Constitution of India.
The writ petition bereft of any merit is accordingly dismissed.
