HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH ?Court No. - 18 Case :- CONTEMPT APPLICATION (CIVIL) No. - 2159 of 2019 Applicant :- Sanjay Kumar Maurya Opposite Party :- Ms. C.Indhumathy District Magistrate Sultanpur Counsel for Applicant :- Anil Kumar Pandey Hon'ble Alok Mathur,J.
1. Heard Sri Anil Kumar Pandey, learned counsel for the applicant as well as Sri Vinayak Saxena, Standing counsel appearing on behalf of the respondents.
2. Sri Vinayak Saxena has placed reliance on the affidavit of compliance filed by the opposite parties stating that District Magistrate, Sultanpur has decided the representation of the applicant by means of order dated 16.11.2019 and, hence, submitted that full compliance has been made to the order of the writ Court dated 29.1.2019 passed in writ petition No.2624 (S/S) of 2019 and the case of the applicant for regular appointment on the post of Collection Peon has been rejected after considering various rules and the judgments in this regard.
3. Learned counsel for the applicant contends that the representation has not been decided in terms of the rules which are applicable in the case of the applicant. Be that as it may, this Court in exercise of contempt jurisdiction would not go into the merits of the claim of the applicant which can appropriately be dealt with in appropriate proceedings where the order can be assailed.
4. Considering the fact that opposite parties have proceeded to pass appropriate orders on the representation of the applicant, it cannot be said that they now run in contempt of the orders of this Court. The contempt petition is accordingly dismissed. Notices, if any, stand discharged.
Order Date :- 11.4.2022 (Alok Mathur, J.)
