Heard learned counsel for the petitioner.

This petition has been filed seeking a direction to Civil Judge (S.D.), Kanpur Nagar to decide the Rent Case No. 217 of 2018 filed under Section 21(1)(a) of the Act No. 13 of 1972 within a stipulated time.

Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, this petition at this stage stands disposed of with liberty to the petitioner to move appropriate application before the court below for expeditious disposal of the case in the light of Rule 15 (3) of the Rules framed under Act 13 of 1972, which shall be considered and decided sympathetically in the light of the judgment of the Hon'ble Apex Court in the case of Hameed Kunju vs. Nazim, 2017 (8) SCC 611 in which it has been observed that the object of the rent laws all over the State is to ensure speedy disposal of eviction cases between the landlord and tenant and especially those cases where the landlord seek eviction for his bona fide need, as expeditiously as possible, in accordance with law and thereafter the Court may proceed accordingly.

No costs.
