Certified copy of the First Information Report filed today is taken on record.

Heard Shri Ran Vijay Chaubey holding brief of Shri Krishna Dutt Tiwari, learned counsel for the petitioners, Shri Umesh Kumar Dubey, learned counsel for the respondent no.4 and the learned AGA for the State.

By this writ petition, a challenge is made to the first information report No.0375/2020 registered on 18.12.2020 for offence under Sections 147, 323 IPC with Police Station Mungra Badshahpur, District Jaunpur. The main ground for challenge to the First Information Report is that the content therein does not disclose any offence.

To analyze the arguments aforesaid, we have gone through the first information report and find that no offence has been disclosed therein.

In view of the above, the present case is covered by the judgment of the Hon'ble Supreme Court in the case of State of Haryana Vs. Bhajan Lal and others; 1992 SCC (Cr.) 426.

Accordingly, the first information report dated 18.12.2020 registered in Case Crime No.375 of 2020, under Sections 147, 323 IPC, Police Station Mungra Badshahpur, District Jaunpur is quashed. The writ petition is allowed.
