C.M. Application No.143369 of 2019

1. This application seeks condonation of delay in filing the revision.

2. I have perused the application and, the affidavit filed in support thereof.

3. The reasons shown in the affidavit seem to be sufficient and plausible.

4. Thus, the application is allowed and the delay is hereby condoned.

On Memo

1. This criminal revision under Section 19(4) of the Family Courts Act has been filed against the judgment and order date 15.06.2019 passed by the Additional Principal Judge, Family Court-II, Sultanpur in Criminal Case No. 879 of 2014, awarding maintenance of Rs.3,000/- per month to revisionist no. 1 and Rs.2,000/- per month to revisionist no. 2 from the date of order.

2. The revisionists have sought modification of the order to the extent firstly; the maintenance may be enhanced from total Rs.7,000/- to Rs.10,000/- per month and; secondly the maintenance may be directed to be paid to the revisionists from the date of application i.e. 10.12.2009.

3. The learned Family Court, after considering the facts and circumstances of the case, including the economic condition and earning of the respondent no. 2, has granted maintenance to the revisionists, as mentioned above. I do not find any force in the submissions made by the learned counsel for the revisionists to enhance the maintenance at this stage.

4. Therefore, the present revision is hereby dismissed. However, it is open to the revisionists to pursue there remedy for enforcement of the order dated 15.06.2019 passed by the learned Principal Judge, Family Court-II, Sultanpur.
