Heard Sri Brij Bihari Yadav holding brief of Sri Suneel Kumar Rai, learned counsel for the petitioners, Sri Ramendra Pratap Singh assisted by Ms. Ishita Sand, for Respondent no.2 and learned Standing Counsel for the State.

The petitioners are land owners, whose lands at Village- Tulsiana, Tehsil- Dadri, District- Gautambudh Nagar were acquired by the Authority and it is not disputed that they have been paid additional compensation to the extent of 64.7%, but the present writ petition has been filed for allotment of 10% of developed land.

Sri Ramendra Pratap Singh assisted by Ms. Ishita Sand, learned counsel for the Authority has placed before the Court the judgment of the Apex Court in (2018) 14 SCC 346, Khatoon and others Vs. State of Uttar Pradesh and others, as also several judgments of Division Bench, i.e, (i) 2016(8) ADJ 79 (DB), Mange @ Mange Ram Vs. State of U.P. and others, (ii) Writ-C No. 10262 of 2020, Jai Kumar Sharma and 3 others Vs. State of U.P. and 3 others, (iii) Writ-C No. 34922 of 2019, Gajraj Vs. State of U.P. and 3 others and (iv) Writ-C No. 35693 of 2019, Smt. Maya Devi and 5 others Vs. State of U.P, and 2 others, wherein similar request was declined, which learned counsel for the petitioners is unable to controvert.

We have perused the above judgments and find that there is considerable merit in the statement of Sri Singh. We accordingly are of the view that the petition is also bereft of merit in view of above, which is liable to be dismissed.

The writ petition is dismissed. No orders as to costs.
