This review application no. 35751 of 2021 has been filed praying for review of judgment and order dated 3.11.2020 passed by me in Writ Petition No. 18761 of 2020 (Misc. Single) Arvind vs. State of U.P. Thru. Prin. Secy. Food & Civil Supplies & Ors.

Learned counsel for the petitioner says that in the order passed by this Court, has failed to notice the pleading made by the petitioner in paragraph nos. 6 and 7.

This Court has carefully perused the judgment and order dated 3.11.2020 it finds that the judgment has been passed on the basis of arguments raised in Court by the counsel for the petitioner. It is well settled law that no matter what averments have been made in the memo of the petition/appeal, the Court has to consider the arguments raised before it and pressed by the counsel for the petitioner in this case. Learned counsel for the petitioner has not filed any affidavit saying that at the time of arguments he has brought to the notice of the Court the pleadings made in paragraph nos. 6 and 7 of the writ petition.

This Court is concerned, only with error apparent on the face of the record as a review petition cannot treated as an appeal in disguise. The judgment and order dated 3.11.2020 has considered in detail all arguments/grounds raised by the learned counsel for the petitioner before it. This Court therefore does not find any good ground to entertain the review application.

The review application is rejected.
