HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 48

Case :- SPECIAL APPEAL DEFECTIVE No. - 249 of 2021

Appellant :- Dharam Narayan Diwedi

Respondent :- State Of U.P. And 3 Others

Counsel for Appellant :- Kaushal Kishor

Counsel for Respondent :- C.S.C.

Hon'ble Munishwar Nath Bhandari,J.

Hon'ble Ajai Tyagi,J.

This appeal has been preferred against the judgment dated 28.01.2021 passed by learned Single Bench in Writ-A No. 14031 of 2020 whereby challenge to the order of transfer was not accepted.

The fact recorded in the impugned judgment shows transfer on administrative ground without violation of statutory provisions or suffers from malafide.

In view of the above, a transfer order cannot be interfered even if it has been passed in defiance of the administrative order or a circular. It is also a fact that petitioner has already joined at the place of transfer on 18.01.2021 and the period of aforesaid comes to be more than 5 months.

In the light of the aforesaid, we find no reason to cause interference in the judgment of learned Single Bench.

The appeal is, accordingly, dismissed.

Order Date :- 21.6.2021
