Order on bail application

Heard learned counsel for the appellant-applicant and learned A.G.A. for the State.

This present appeal was admitted on 16.3.2021 and direction was issued for consideration of bail application. Today the matter is listed for consideration on bail application.

The present bail application has been filed by the applicant-appellant in Special Criminal Case No.54 of 2016 (State Vs. Devendra) arising out of Case Crime No. 139 of 2016, under Section 3/4 POCSO Act and Section 323 and 506 I.P.C., Police Station Moosajhag, District Budaun with the prayer to enlarge the applicant-appellant on bail.

I have perused the judgment and order dated 5.2.2021 passed by the trial court convicting the applicant-appellant.

The contention of the counsel for the appellant-applicant is that the appellant-applicant is in custody since 20.4.2016 and has served half of the sentence given to the appellant by means of the impugned judgment.

Learned A.G.A. has opposed the bail application.

Considering the submissions recorded above and without expressing any opinion on merits of the case, I find that the appellant is entitled to be enlarged on bail.

Let appellant-applicant Devendra convicted and sentenced vide impugned order dated 5.2.2021 be released on bail in the aforesaid case crime on his furnishing a personal bond and two local sureties each of the like amount to the satisfaction of court concerned subject to deposit of fine of Rs.10,000/- with the court concerned.

As soon as personal bonds and surety bonds are furnished, photocopies of the same are directed to be transmitted to this Court forthwith by trial Judge concerned to be kept on the record of this appeal.
