The present criminal application under Section 482 Cr.P.C. has been moved against the impugned judgment and order dated 07.03.2007 passed by learned Judicial Magistrate (I), Chhata, District Mathura in Case No. 182/XI of 1997 (Smt. Shyamavati Versus Kunwarpal) under Section 125 Cr.P.C.whereby the maintenance allowance granted to the applicant was enhanced from Rs.200/- to Rs. 300/- per month. The further prayer is to increase the maintenance to the tune of Rs.5,000/- per month.

Heard learned A.G.A. for opposite party no.1 and perused the record.

From the perusal of the record, it is evident that learned Judicial Magistrate-III, Mathura by his order dated 14.12.1995 has allowed maintenance allowance to the tune of Rs.200/- per month which was subsequently enhanced to Rs.300/- per month.The impugned order is just, proper and legal and does not suffer from any illegality, infirmity or jurisdictional error.

Accordingly, the application under Section 482 Cr.P.C. is disposed of.

Certify this judgment to the lower Court immediately.
