Heard Sri Uma Nath Pandey, learned counsel for the applicant and Sri Pankaj Saxena, learned counsel appearing for the State-opposite party.

The present application has been filed seeking to quash the impugned judgment and order dated 18.02.2021 passed by the IIIrd Additional Sessions Judge, Basti in Criminal Revision No.102 of 2020 (Jamirunnisha v. State of U.P. and Others), Police Station- Kotwali, District- Basti.

Sri Pankaj Saxena, learned AGA-I appearing on behalf of State-opposite party points out that in terms of the order passed by the revisional court, which is sought to be challenged, the matter has simply been remanded to the Magistrate and in view thereof, there is no occasion to challenge the order.

Learned counsel for the applicant does not dispute the aforesaid position and states that the applicant does not wish to press the application.

Application stands accordingly dismissed.
