Heard Shri H.P. Mishra, learned counsel for the petitioner and Shri Anurag Rai, learned counsel appearing on behalf of respondents.

The petitioner has preferred the present petition inter-alia with the prayer to set aside the impugned judgment and orders dated 17.02.2021 and 12.09.2018 passed by the court below.

After some arguments a prayer has been made by the counsel for the petitioner to direct the court below to decide the Original Suit No. 807 of 2004, expeditiously.

Considering the facts and circumstances of the case, without interfering with the orders passed by the court below and without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Senior Division), Basgaon, Gorakhpur to consider and decide the aforesaid suit in accordance with law most expeditiously and preferably within a period of one year from the date of production of copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
