This criminal appeal has been filed against the judgment and order dated 16.1.2002 passed by the Additional Sessions Judge, Budaun in S.T. No. 760 of 1999 (State vs. Kailash Kumar Singh) under Sections 308, 504 and 506 IPC arising out of Crime No. 161/98, Police Station - Kotwali, District - Budaun.

From perusal of the report of Chief Judicial Magistrate, Budaun dated 14.04.2021, it transpires that the sole appellant- Kailsash Kumar Singh has died.

In view of the above stated fact that the sole accused / appellant has since expired during course of the pendency of this appeal, this criminal appeal stands abated.

Consequently, this criminal appeal is dismissed as abated on account the death of the accused-appellant.

The present criminal appeal is accordingly dismissed as abated.
