The present writ petition has been filed alleging that the post-retiral dues of the petitioner was paid, however, the amount of gratuity has not been paid. It is also alleged that husband of the petitioner died while in service on 21.5.2012 but no death-cum-retirement gratuity has been paid. The petitioner has made several representations which are still pending consideration before the Respondent No. 3.The petitioner alleged that the controversy with regard to non-payment of pension stands concluded by the judgment of this Court in the case of Smt. Sarvesh Kumar Vs. State of UP and others decided on 14.5.2019.

Considering the fact that the matter is yet to be decided by the Respondent No. 3, the present writ petition is disposed off with liberty to the petitioner to file a fresh representation along with whatever judgment he may choose to rely on before the Respondent No. 3. In the event, such a representation is filed, a decision shall be taken thereupon in the light of the law as decided by this Court as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order.

This order has been passed in the presence of Sri Mrigraj Singh, counsel for the respondents.
