The present contempt petition has been preferred by the applicant for non-compliance of the judgment and order dated 27.08.2020 passed in Writ A No. 6268 of 2020 (Udai Shankar Chaudhary vs. State of U.P. And 4 Others). The order is reproduced below:-
"Heard learned counsel for the petitioner and Sri Pranav Ojha, learned Additional Chief Standing Counsel on behalf of respondents no.1 to 3.
The petitioner has preferred the present writ petition inter-alia with the following prayers:-
"1. A writ of mandamus to direct the respondents to pay the IInd and IIIrd Assured Career Probation (A.C.P.) to petitioner with 18% interest.
2. A writ in the nature of mandamus to decide the representation dated 19.06.2020 (Annexure No.3) to the writ petition."
It is argued by learned counsel for the petitioner that inspite of the fact that petitioner has already retired on 20.2.2017 till date 2nd and 3rd Assured Career Probation was not paid to him. In this regard various representations were made by the petitioner immediately before the authorities but till date no decision has been taken on the same.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the petitioner is permitted to make a fresh representation ventillating all his grievances before the respondent no.2/Upper Education Director (Basic), Prayagraj, along-with self attested computer generated copy of this order downloaded from the official website of High Court Allahabad within a period of three weeks from today. If such a representation is made, the respondent no.2 is directed to pass appropriate order in accordance with law within a further period of three months.
With the aforesaid observations, present writ petition is disposed of finally."
Shri K. R. Singh, learned counsel appearing on behalf of opposite party placed before this Court an letter dated 21.07.2021 written by the Director of Education (Basic), the same is taken on record.
It is argued by Shri K. R. Singh, counsel for the opposite party on the basis of the instructions that the opposite party will comply with the order passed by Writ Court within four weeks.
In the facts and circumstances of the case, the present contempt application is disposed of finally granting one more opportunity to opposite party to comply with the order passed by Writ Court within six weeks from today.
With the aforesaid observations, the present contempt petition is disposed of.
