2021 Latest Caselaw 8466 ALL

Citation : 2021 Latest Caselaw 8466 ALL
Judgement Date : 22 July, 2021

Allahabad High Court
Satyavir Singh vs State Of U.P. And 4 Others on 22 July, 2021
Bench: Ashwani Kumar Mishra

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 33

Case :- WRIT - A No. - 5182 of 2021

Petitioner :- Satyavir Singh

Respondent :- State Of U.P. And 4 Others

Counsel for Petitioner :- Anil Kumar Srivastava,Rakesh Kumar Verma

Counsel for Respondent :- C.S.C.,Ram Bilas Yadav,Vivek Kumar Rai

Hon'ble Ashwani Kumar Mishra,J.

Termination order under challenge herein is pursuant to orders passed by the learned Single Judge in a bunch of writ petitions on 29.4.2020, against which the appeal filed has also been rejected. The impugned order, dated 2.3.2021, passed by respondent no. 4, is assailed on the ground that orders passed by the Division Bench and learned Single Judge of this Court has been stayed by the Supreme Court on 1.7.2021 in Special Leave to Appeal (C) No(s). 7157-7160 of 2021.

The order of the Hon'ble Supreme Court is specific in so far as the interim protection has been granted only to the petitioners who were present before the Supreme Court and assailed the orders passed by this Court.

Learned counsel does not dispute that he has not challenged the order passed by the Single Judge as affirmed in Appeal. Merely because relief has been granted to other persons would not mean that consequential order would be stayed in the present case also, inasmuch as, special appeal filed by the present appellant has already been dismissed and the judgment in that regard has not been interfered with by the Supreme Court. Merely because other persons have been granted such relief would not mean that consequential order challenged in the present writ petition can be interfered with. Since there is no stay order passed in petitioner's writ petition and special appeal, the consequential order cannot be interfered with.

The writ petition is dismissed, accordingly.

Order Date :- 22.7.2021
