HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 86 Case :- CRIMINAL REVISION No. - 818 of 2002 Revisionist :- Prem Singh Opposite Party :- State of U.P. Counsel for Revisionist :- Gaurav Kumar Srivastava Counsel for Opposite Party :- Govt. Advocate Hon'ble Umesh Kumar,J.
Called in revised. None appeared to press this revision. In the circumstances, I myself have perused the record.
This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by the judgments and orders dated 01.02.2002 and 08.05.2005 passed by Chief Judicial Magistrate, Aligarh and Additional District and Sessions Judge,Court No.2, Aligarh whereby bail application of the applicant-revisionist filed under Section 12 of Juvenile Justice Act, 2000 has been rejected and the appeal preferred against the same has also been dismissed in Criminal Appeal No.12 of 2002 under Section 52 of Juvenile Justice Act, 2000 (Prem Singh Versus State) arising out of Case Crime No.06 of 2002 under Section 302 I.P.C., Police Station Sasni Gate, District Aligarh. Being aggrieved the revisionists preferred present revision.
This revision was filed in the year 2002 for release of revisionist on bail. No order granting bail to the revisionist was ever passed. The trial must have concluded. It seems that the counsel for the revisionist has no interest in final disposal of this revision. This matter also appears to have lost its efficacy due to efflux of time.
In the fact and circumstances of the case this revision is dismissed as having become infructuous.
Certify this judgment along with lower court record to court below immediately.
