Petitioner asserts that the respondent Commission has erroneously discarded his candidature for appointment to the post of Assistant Statistical Officer, inasmuch as, she possesses requisite qualification and ought to have been called for interview.
The qualification is prescribed in the advertisement, which is at page 19. The relevant qualification for the present purposes is 'O' Level Diploma in Computer awarded by DOEACC Society or at least one year Diploma in Computer Science from any recognized University/Institution. It is admitted that petitioner does not possess 'O' Level Diploma in Computer from DOEACC Society. Petitioner however asserts that Computer Science was one the papers in the B.Sc. Course, which she has passed from Rani Durgawati Vishwavidyalaya, Jabalpur and, therefore, petitioner cannot be held to be lacking the minimum qualification for appointment.
Sri Nipun Singh, learned counsel for the Commission points out that merely studying Computer Science, in one paper of B.Sc. Course, cannot be treated equivalent to one year diploma in computer science and, therefore, the Commission has rightly discarded petitioner's candidature. Reliance is placed upon a judgment of this Court in Writ Petition No. 13091 of 2019, Shrawan Kumar and 5 others Vs. U.P.P.S.C. to submit that similar issues have already been decided against the petitioner.
In the facts of the present case, it is apparent that petitioner does not hold 'O' Level Diploma in Computer awarded by DOEACC Society. The requirement of possessing one year diploma in computer science also cannot be claimed to be possessed merely because computer science was one of the papers in the B.Sc. Examination. The Graduation obtained by the petitioner is in science stream wherein large number of subjects were being taught, one of which, was computer science. Such qualification cannot be treated to be equivalent to diploma in computer science. In such circumstances, no illegality is said to have been done by the Commission in discarding petitioner's claim for appointment on account of lack of qualification.
The writ petition is dismissed.
