No. 10650(M/B)2021] Opposite Party :- State Of U.P. Thru. Addl.Chief Secy. Panchayat Raj,Lko.&Ors. Counsel for Applicant :- Santosh Kumar Pandey Counsel for Opposite Party :- C.S.C.,Rakesh Kumar Chaudhary Hon'ble Rajan Roy,J.
Hon'ble Saurabh Lavania,J.
Heard learned counsel for the applicant, learned Addl. C.S.C for the State and Sri R.K. Chaudhary, learned counsel for the opposite parties.
Having heard learned counsel for the applicant seeking review of the judgment dated 19.05.2021 passed in Writ Petition No.10650 (M/B) of 2021, we do not find any valid ground for reviewing the said judgment. However, we find that there are two factual errors in the said judgment which have been noticed by us in our order dated 25.06.2021 which need to be corrected.
The mention about the number of votes polled by which the petitioner is alleged to have lost the election which is mentioned as '200 votes', is in fact, 'one vote'. The judgment dated 19.05.2020 shall be treated as corrected accordingly.
Furthermore, the reference to 'Section 27 of the Kshetra Panchayat and Zila Panchayat Adhiniyam, 1961' in the said judgment should be read as a reference to 'Section 14(2) of the Kshetra Panchayat and Zila Panchayat Adhiniyam, 1961'. The judgment shall be corrected accordingly.
The application for review is disposed of with the aforesaid terms.
