Shri H.R. Mishra, learned Senior Advocate assisted by Shri Gopal Das Srivastava, appearing for the petitioner states that while passing the order impugned dated 10.10.2019 the Finance Controller, Directorate of Higher Education, U.P. Allahabad has erred in law, whereas a Division Bench of this Court vide judgment and order dated 01.5.2018 passed in Writ A No.51900 of 2014 filed by the petitioner directed to the respondents to pay interest on delayed amount of provident fund of petitioner @ 8 per cent per month (simply) from February, 2010 till it has actually been paid to him within three months. He submits that the calculation so made by the respondents is erroneous on the face of record and prayed for payment of balance amount of Rs.13,45,880/- in compliance of the aforesaid order dated 01.5.2018.
Before proceeding in the matter, one more indulgence is accorded to the Director of Higher Education, U.P. Allahabad/respondent no.1 and Finance Controller, Directorate of Higher Education, U.P. Allahabad/respondent no.4 to ensure payment of the amount in question as per mandate of the Division Bench dated 01.5.2018 passed in the aforesaid writ petition or file their personal affidavit in the matter. In case there is any infirmity, which is writ large, the authority would be at discretion to rectify such error.
