Heard Sri Vinay Kumar Tripathi, learned counsel for the applicants, Sri G.P. Singh, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer to direct the court below to decide the S.T. No. 349 of 2007 (State vs. Anoop Singh and others) which is pending in the court of Additional District Judge, Court NO. 1, Mathura.
Submission made by the learned counsel for the applicant is that the applicant is an informant of this case and this case is of the year 2017. In the year 2017, statements of accused under section 313 Cr.P.C. were recorded and even arguments were heard but judgment could not be delivered and thereafter this case is being transferred from one court to another and this is resulting in delay. Therefore, he has made a prayer before this Court through present application praying that a direction to be issued to the trial court to decide the case expeditiously.
It is directed that the court below shall make all endeavour to decide this case expeditiously preferably within a period of three months from today, if there is no legal hurdle, without permitting undue adjournments to either side.
With this direction, this application is disposed of without issuing any notice to opposite party nos.2 and 3 as it is an innocuous order. If the opposite party nos. 2 and 3 feel aggrieved, he may approach this Court.
