Heard learned counsel for the petitioner and Sri Piyush Shukla, learned Additional Chief Standing Counsel for the State respondent.
The claim of the petitioner is for the grant of promotion to the post of Head Constable in light of his position as obtaining in the seniority list of 7 March 2018. In paragraph 20 of the writ petition it is alleged that while various juniors of the writ petitioner have been accorded promotion, the same was denied to him in light of certain orders of punishment which operated. Learned counsel for the petitioner draws the attention of the Court to the final judgment rendered inter partes on Writ A No. 5410 of 2015 (Rajesh Kumar Vs. State of U.P. and 3 others) in terms of which the orders of punishment which appear to have been taken into consideration for denial of promotion have since been quashed and set aside.
In view of the aforesaid, learned Standing Counsel representing the Board submits that the claim of the petitioner for promotion to the post of Head Constable shall be duly considered in accordance with law and bearing in mind the judgment rendered on the writ petition aforementioned and a final decision communicated to the petitioner with expedition and preferably within a period of two months from the date of presentation of a duly authenticated copy of this order along with a copy of the writ petition and its enclosures.
Petition stands disposed of.
