Sri Sashi Prakash Singh, learned Additional Solicitor General of India assisted by Sri Shivam Shukla, learned counsel for the Central Government raises a preliminary objection. It is submitted that the petitioner has an alternative remedy of filing objection before the Central Administrative Tribunal. He relies on the judgment of Hon'ble Supreme Court in the case of L. Chand Kumar Vs. Union of India reported at 1997 (3) SCC 261.

Faced with this Sri Mujib Ahmad Siddiqui, learned counsel for the petitioner, in his usual fairness, does not dispute the aforesaid proposition of law. He does not press relief sought in the writ petition. He recasts his prayer.

The only prayer made by Sri Mujib Ahmad Siddiqui, learned counsel for the petitioner is that petitioner may be permitted to avail the alternative remedy.

It is always open to the petitioner to avail the remedy open to him in law.

The writ petition is disposed of.
