Heard learned Counsel for the petitioners and Sri Ran Vijay Singh, learned Additional Chief Standing Counsel.

After arguing at some length, learned Counsel for the petitioners has confined his prayer only to the extent that a direction may be issued to the District Magistrate/ Collector, Sitapur (opposite party no.3) to consider and decide the case of the petitioner in the light of the judgment and order dated 03.12.2013 passed by a Division Bench of this Court in the case of State of U.P. Vs. Pankaj Srivastava (Special Appeal Defective No.845 of 2013].

Sri Ran Vijay Singh, learned Additional Chief Standing Counsel has no objection in case a direction is issued to the District Magistrate to consider and decide the case of the petitioner in accordance with law.

In view of the above, without entering into merits of the issue, the petitioner is directed to move a fresh representation along with a copy of the writ petition as well as a copy of the order dated 03.12.2013 passed by a Division Bench of this Court in the case of State of U.P. Vs. Pankaj Srivastava [Special Appeal Defective No.845 of 2013] and a copy of this order before the opposite party no.3 within 10 days from today.

Upon receipt of the said representation, the opposite party no.3 shall consider and decide the same in the light of order dated 03.12.2013 and pass a speaking and reasoned order, with expedition, preferably within a period of two months from the date of production of certified copy of this order along with representation and a copy of writ petition and a copy of the order dated 03.12.2013.

In view of the aforesaid terms, the writ petition is disposed of finally.
