The petition seeks issuance of a writ in the nature of mandamus directing respondent no.2 to consider the case of the petitioner for promotion on the post of Head Constable from the date when juniors have been given promotion i.e. year 2018, with all consequential service benefits..

At the outset, learned counsel for the petitioner has made an innocuous prayer that the petitioner may be given liberty to represent his case before the competent authority and the said authority may be directed to decide the same in terms of judgment and order dated 23.11.2020 passed in Writ Petition No.6821 (SS) of 2015 (Raghvendra Singh Yadav v. State of U.P. & Ors.) vide which punishment of censure entry imposed on the petitioner has been set aside.

Learned Addl. Chief Standing Counsel has submitted that he has no objection to the innocuous prayer made by petitioner's counsel.

I have heard learned counsel for the parties and perused the record.

Without commenting upon the merits of the case, the petitioner is directed to move a fresh detailed representation alongwith a copy of this order before respondent no.2/Chairman, U.P. Recruitment and Promotion Board, Lucknow within 10 days from today, who shall consider and decide the same in terms of judgment and order dated 23.11.2020 (supra) in accordance with law by way of passing a reasoned order expeditiously, preferably within two months from the date of receipt of the said representation.

The order so passed shall be communicated to the petitioner forthwith.

With the aforesaid directions, the instant petition is disposed of.
